وقد تضمنت المادة ٣٤٧ من المرسوم المشار إليه الجرائم التي يجوز فيها الصلح، هذا ويترتب على الصلح انقضاء الدعوى الجزائية في حال كانت القضية قيد التحقيق لدى النيابة فيتم حفظها وإن كانت ثابتة في حق المتهم من ثم لا تعد سابقة يقتضي معها رد الاعتبار، أو وقف تنفيذ العقوبة المحكوم بها ولو بعد صيرورة الحكم باتا، فالمشرع أعطى للمتخاصمين فرصة سانحة للصلح ودعاهم إليه حتى بعد صدور الحكم وصيرورته باتا.
